RENTAL AGREEMENT & RULES (Updated 10/3/06)

1. ARRIVAL: When you arrive, our home should be clean and set up with linens and the supplies listed below. Please call and let us know you have arrived, or leave a message if we are not able to answer 909-337-7391.

2. CHECK-IN TIME IS AFTER 3 P.M. AND CHECK OUT IS 11:00 A.M., unless otherwise noted above. NO early check-ins. If you do not leave the premises on time, you will be charged for one additional night's stay. This agreement does not create a tenancy for the property. You can be removed from the property without process of law if you do not depart at the appropriate, contracted time.

3. SMOKING: This is a NON-SMOKING home. If our super-sensitive noses detect that you have smoked on the premises, your ENTIRE security/damage deposit will be retained. This is HIGH fire danger country. Please, no incense or candles for the same reasons.

4. PETS: Our pet fee is $25 per night, $100 maximum. Our $300 security/damage deposit is raised to $400 if you bring pets. We limit to 2 pets total. Pets must be pre-approved and a separate agreement must be signed and returned. Bringing pet without prior approval, deposit, and fee is grounds for immediate eviction.

5. NOISE: Quiet hours: 10 p.m. to 7 a.m. by law. Noise/nuisance from you will be subject to immediate termination of occupancy and $500 fine.

6. BEACH CLUB CARD: Beach Club card is provided in our home to admit 5 guests to private Lake Arrowhead's beaches, clubs, fishing, and trails. Please let us know in advance if you need and an extra card to admit a total of 10 (see Maximum Occupancy section). No entry without this card. If you lose this card(s), you lose your security deposit of $300. There are NO free public beaches on Lake Arrowhead. You may not launch your own boat or kayak, since Lake Arrowhead requires special licenses and permits.

7. DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit of $300 is required by credit card. This must be received within seven (7) days of booking the reservation. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied
toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met:

a. No excessive cleaning is needed. Cleaning in excess of normal will be charged at the rate of $40 per hour.

b. No damage is done to the rental home or its furniture and contents, beyond normal wear and tear. Guest agrees to pay for any damages Guest causes, plus the loss of use subsequent income for the time it takes to repair/replace the damaged item(s).

c. No charges are incurred due to contraband or collection of rents or services rendered during the stay.

d. All soiled dishes are placed in the dishwasher and cleaned. Any wet laundry should be left on the on the washing machine. Leave trash in the trash baskets or trash can outside on the brick patio. We will empty your reasonable amount of trash for you. If you have an unreasonable amount of trash, please take it home with you. We do NOT have trash pickup. If you need trash pick-up before your scheduled day, please call us and arrange it.

e. Vacation home is left locked.

f. All charges accrued during the stay are paid prior to departure.

g. No linens, DVDs, videos, books, or games are lost or damaged.

h. NO early check-in or late check out without prior written permission.

i. Gas on BBQ and fireplace is off. (Gas left on loses entire security deposit.). Please be respectful of your use of fireplace gas-this is our highest utility bill.

j. All equipment and furniture (i.e. chairs, remotes, phones, etc.) is returned to its original location.

8. SUPPLIES PROVIDED: We will provide the following supplies for each guest: bath towel, washcloth, hand towel, beach towel. Our home will be furnished with dish towels, dishcloths; hand dishwashing liquid, dishwasher compound; hand soap, shampoo, conditioner, liquid body soap, 1 roll paper towels, 2 rolls of toilet paper per bathroom, laundry soap. We will have a small amount of kitchen staples, such as: sugar & Splenda, powdered creamer, coffee, cocoa, teas, flour, oil, pan spray, spices, ketchup, mustard.

9. CHILD SAFETY

a. We supply games and activities for our guests, however some games have small pieces or parts and are not suitable for young children who may put things in their mouths. Do not allow young children to play unsupervised with games.

b. We do not, by any means, guarantee our home to be safe for children. Supervise your children carefully at all times.

10. PAYMENT - An advance payment equal to 50% of the rental rate is required 60 days before arrival. The advance payment will be applied toward the room rent. Please make payments in the form of personal checks or U.S. Postal money orders payable to Leggewie Enterprises, Paypal, or Mastercard, Visa, or Discover. The advance payment is not a damage deposit. The BALANCE OF RENT is due thirty (30) days before your arrival date. If your stay is less than 2 weeks away, we accept only Visa, Mastercard, or Discover.

11. CANCELLATIONS - A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty except if deposits were made via credit card. All credit card cancellations are subject to a 5% cancellation fee or $50 whichever is greater. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and damage/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit. Please consider travel insurance.

12. MONTHLY RESERVATION CANCELLATIONS - Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in. Please consider travel insurance.

13. REFUNDS - Changes in furniture, decor, or amenities, or inconveniences such as power outages, road closures, weather conditions, acts of God, terrorism, presence of mold or airborne spores, allergic reactions, sensitivity to cleaning supplies used, neighborhood construction, neighborhood, camp noise or road noise, will not allow you to reduce or eliminate the rate of your stay.

14. MAXIMUM OCCUPANCY- The maximum number of guests is limited to eight (8) persons. One baby is not counted in the maximum or extra person charge. If you have more than the number of people agreed on, we may terminate your occupancy immediately.

15. THIS PROPERTY REQUIRES A TWO (2) NIGHT MINIMUM STAY; 3-4 nights during peak and holiday seasons.

16. INCLUSIVE FEES - Rates include a one-time linen-towel setup. Amenity fees are included in the rental rate. See rates on our home page for optional extras.

17. NO DAILY MAID SERVICE - While linens and towels are included in the vacation rental, daily maid service is not included in the rental rate.

18. RATE CHANGES - Rates subject to change without notice. Receipt of your deposit locks in your price for the reserved dates of this agreement.

19. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

20. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance.

21. PARKING- Parking is limited to three (3) vehicles. Vehicles are to be parked in our garage or direction in front of the garage or in the dirt between the garage and house. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner. Do NOT block snowplows or you are subject to a fine and towing.

22. STORM POLICY/ROAD CONDITIONS - No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained, however we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions, however, if ALL roads are closed and you are not able to reach the vacation home, the time period that is beyond your control will be refunded pro-rata. You may have to shovel if we are unable to get to you to help.

23. PARTIES - Our home is not a "party house." You must stay within the maximum occupancy for which you have paid for sleeping. We do not intend for our home to be used for parties and/or receptions. Please do not use our home for this purpose. We offer a quiet home, and our neighbors request quiet guests.

24. SUBLETTING - You may not sublet our home under any circumstances.

25. WILDLIFE - Wildlife is normal in the mountains. Please be prepared and warn your children not to touch or entice local wildlife with food. We have a wide variety of wildlife, including, but not limited to: bears, coyotes, deer (rare), bees, yellow jackets, mosquitoes, ticks (rare), and mountain lions (very rare).

26. ITEMS LEFT BEHIND: If you leave an item after checking out and wish to have it returned, call us as soon as possible. We will inform you of the shipping cost and with your approval, deduct it from your deposit refund to cover the expense.

27. UTILITIES/TELEPHONE: We provide utilities for your stay, provided that your usage is normal for your agreed number of guests in your group. Cable TV and Internet is provided, but not guaranteed if there is an outage beyond our control. We cannot guarantee that utilities will not be interrupted due to circumstances beyond our control (i.e. trees falling on power lines, snow outages, fire, etc.). Free phone calls are limited to calls within the 48 continental United States, not including Alaska & Hawaii, unless you use your own calling card. We suggest bringing your own cell phone and calling card. Cell phones do not work in all areas of the mountains.

28: NO SIGNERS UNDER 25. We do not rent to persons under 25 years of age except with written permission advance.

29. RISK:

a. Our vacation home privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss or theft of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

b. By renting our home, you assume responsibility for it and its contents as well as your personal property. Be sure to lock the door when you leave, and do not share your entry code with anyone else.

I AUTHORIZE LEGGEWIE ENTERPRISES TO CHARGE THE CREDIT CARD PROVIDED FOR ADDITIONAL COSTS ABOVE THE AMOUNT OF THE SECURITY DEPOSIT. I HAVE PROVIDED ACCURATE CREDIT CARD INFORMATION, AND WARRANT THAT THE CREDIT LIMIT HAS SUFFICIENT AVAILABLE CREDIT TO COVER CHARGES I MAY INCUR ABOVE THE SECURITY DEPOSIT. SHOULD MY CREDIT CARD EXPIRE, I AGREE TO PROVIDE NEW CREDIT CARD INFORMATION AS NEEDED.

PET AGREEMENT (v. 7/31/06)

Pets must be pre-approved and this separate agreement must be signed and returned. Bringing pets without prior approval, deposit, and fee is grounds for immediate eviction. Please be considerate of future pet owners, as we are doing this as a trial run.

a. Pets are not permitted in our beach clubs.
b. Keep your pet(s) under control at all times.
c. Your dog must be housebroken.
d. Keep your pet(s) off the furniture and bedding at all times.
e. Adhere to local ordinances, leash laws and licensing requirements.
f. Clean up after your pet(s) & dispose of the pet(s') waste promptly. We will bill you at $40 per hour if we have to clean up after your pets.
g. Keep pet(s) from being noisy or aggressive and from causing any annoyance or discomfort to others. You promise to remedy any complaints immediately. If your dog becomes a barking nuisance, you may be evicted and lose all remaining monies, including your security deposit.
h. Agree that your pets are appropriately and currently treated for flea and tick prevention & will be current in their treatment at time of check-in.
i. You agree to pay for any damage, loss or expense caused by your pets.
j. Guest linens and towels will not be used on your pet.
k. Dogs will not be washed in the bathtubs or showers inside our.
l. No personal pet beds or other items used on your pets will be put in our washer or drier.
m. Please crate your dog at night. If not possible, keep your dog on the floor on your dog bedding, and not ours!
n. You may not leave your pet home unattended. Call us if you need dog-sitting information.

WARNING: We are in coyote country. Coyotes WILL and DO attack small dogs, especially if they are not on leash. Keep your dog close to you, even when leashed or outside in the yard.
